§ 1 Definitions
Seller – Lemors sp. z o.o., with its registered office at Domaniewska 37, 02-672 Warsaw, NIP: 5214017868, REGON: 525217925, KRS: 0001034314, registry authority: DISTRICT COURT FOR THE CAPITAL CITY OF WARSAW, 13TH COMMERCIAL DIVISION OF THE NATIONAL COURT REGISTER, share capital: PLN 5,000.00, email address: [email protected], telephone number: +48 573 56 96 98.
Store – the online store operated by the Seller at www.noxscreen.com.
Customer – a natural person, legal entity, or organizational unit without legal personality who makes purchases in the Store.
Consumer – a natural person who makes a purchase in the Store that is not directly related to their business or professional activity.
Entrepreneur with Consumer Rights – a natural person who enters into a sales contract directly related to their business activity, when the content of the sales contract indicates that it is not of a professional nature for the Entrepreneur, resulting in particular from the subject of their business activity, disclosed pursuant to the provisions on the Central Registration and Information on Business.
Goods – products offered for sale in the Store.
Sales Agreement – a distance contract concluded between the Customer and the Seller via the Store.
Business Day – one day from Monday to Friday, excluding public holidays.
§ 2 General Provisions
These Terms and Conditions define the rules for using the Store, placing orders for Goods, paying the purchase price, delivering ordered Goods to the Customer, the Customer’s right to withdraw from the contract, and the rules for filing and reviewing complaints.
A computer or other device with internet access and a web browser is required to browse the Store’s assortment and place orders.
§ 3 Placing Orders
Information about Goods provided on the Store’s website, in particular their descriptions, technical and performance parameters, and prices, constitute an invitation to enter into a contract within the meaning of Article 71 of the Civil Code.
To place an order, add the selected Goods to the cart and then follow the instructions displayed on the Store’s website.
After placing the order, the Customer will receive an email confirmation of order acceptance. Upon receipt of this message, a Sales Agreement is concluded.
§ 4 Payments and Prices
The prices of all Goods listed on the Store’s website are gross prices (include VAT) and are denominated in Polish zloty (PLN) or Euro, or USD, depending on the buyer’s country.
The online payment service provider is imoje, meaning ING Bank Śląski S.A.
Available payment methods include: online payment via the imoje service (transfer, card, BLIK).
Prices do not include shipping costs, which are added to the final order amount and depend on the shipping method selected by the Customer.
§ 5 Delivery
Ordered Goods are shipped from the territory of the Republic of Poland.
Delivery of Goods takes place to the address provided by the Customer in the order form.
The order processing time is 2 business days from the date the payment is credited to the Seller’s account (in the case of prepaid payments).
Delivery costs within Poland range from PLN 7.99 to PLN 24.99.
Delivery costs within the EU range from PLN 34.99 to PLN 129.99.
Delivery costs to other locations range from PLN 49.99 to PLN 249.99.
§ 6 Right of Withdrawal
The Buyer (Consumer and Entrepreneur with Consumer Rights) has the right to withdraw from the contract in writing without giving a reason within 14 (fourteen) days from the date of receipt of the goods.
The right referred to above also applies to an individual – Entrepreneur with Consumer Rights – concluding a contract directly related to their business activity, if the content of the contract indicates that it is not of a professional nature for that individual, arising in particular from the subject of their business activity, as disclosed under the provisions of the Central Registration and Information on Business.
A declaration of withdrawal from the contract may be submitted, for example, by email to [email protected] or [email protected] or in writing to the Seller’s address. A sample withdrawal form is attached as Appendix 1 to these Terms and Conditions.
In the event of withdrawal from the contract, the Customer is obligated to return the goods in unaltered condition within 14 (fourteen) days of the date on which they withdrew from the contract.
In the event of exercising the right to withdraw from the contract within 14 days, the cost of returning the goods is borne by the Buyer.
The Seller will refund all payments made by the Customer, including the costs of delivery (excluding additional costs resulting from the Customer’s choice of a delivery method other than the least expensive standard delivery method offered by the Seller), immediately, and in any case no later than 14 days from the date on which the Seller was informed of the decision to exercise the right of withdrawal.
- The Seller may withhold the refund of payments received from the Customer until the Goods are received back or the Customer provides proof of having sent back the Goods, whichever occurs first.
- The Seller will refund the payments using the same payment method that the Customer used in the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not incur any fees in connection with this refund.
The right to withdraw from the contract does not apply to contracts where the subject of the contract is an item delivered in a sealed package that cannot be returned for health or hygiene reasons after opening the package (e.g., cosmetics, underwear).
§ 7 Complaints and Warranty
The Seller is liable to the Consumer and the Entrepreneur as a Consumer for any lack of conformity of the Goods with the sales contract, existing at the time of delivery and discovered within two years of the date of delivery of the Goods.
The Seller is liable to the Consumer and the Entrepreneur as a Consumer for this reason under the terms of the Act of May 30, 2014, on Consumer Rights.
Complaints may be submitted by the Consumer or the Entrepreneur as a Consumer by email to [email protected] or [email protected], in writing to the Seller’s address, or via the contact form on the Store’s website.
A complaint should include at least: the Customer’s name and surname, order number, description of the defect, photos, and the Customer’s request.
The Seller undertakes to review each complaint within 14 days of its receipt.
§ 8 Warranty
Goods sold in the Store may be covered by a warranty provided by the manufacturer or distributor. Detailed warranty terms and conditions and the warranty duration are then provided on the warranty card attached to the Goods.
§ 9 Final Provisions
In matters not regulated by these Terms and Conditions, the provisions of Polish law, in particular the Civil Code and the Consumer Rights Act, shall apply.
The Seller reserves the right to amend these Terms and Conditions. These amendments may not violate the rights acquired by Customers.
These Terms and Conditions come into effect on October 1, 2025.
